These Terms of Service ("Terms") govern your use of the State Wide Auto Transport ("SWA") website and auto transport brokerage services. By using our website or services, you agree to these Terms.
1. Services Overview
State Wide Auto Transport operates as a licensed auto transport broker. We connect customers with FMCSA-licensed motor carriers for the transportation of vehicles. SWA does not own or operate transport trucks. All vehicles are transported by independent, licensed carriers within our network.
2. Booking and Payment
- A quote is an estimate based on current market conditions and is not a guaranteed price until a carrier is dispatched.
- A deposit is required when a carrier is assigned and dispatched to your pickup location.
- The remaining balance is due at delivery, payable directly to the carrier driver.
- Accepted payment methods include cash, cashier's check, Zelle, and credit card. Credit card payments may include a 3% processing fee.
3. Cancellation Policy
You may cancel your order at any time before a carrier is dispatched at no charge. Once a carrier has been dispatched and is en route to your pickup location, cancellation fees may apply. The specific cancellation terms will be outlined in your booking confirmation.
4. Vehicle Condition and Inspection
- A Bill of Lading (BOL) will be completed at both pickup and delivery documenting the condition of your vehicle.
- You are responsible for disclosing any known mechanical issues, modifications, or non-operational conditions at the time of booking.
- Non-running vehicles require special equipment and may incur additional charges.
- Personal items left in the vehicle are not covered by carrier insurance and are shipped at your own risk.
5. Insurance and Liability
All carriers in our network are required to carry cargo insurance as mandated by the FMCSA. In the event of damage during transport, claims are filed with the carrier's insurance company. SWA will assist you in the claims process but is not directly liable for damage caused by the carrier during transport. SWA's liability is limited to its role as a broker.
6. Delivery Timelines
All pickup and delivery dates are estimates, not guarantees. Factors such as weather, traffic, mechanical issues, and other pickups/deliveries on the carrier's route may affect timelines. SWA is not responsible for delays beyond our control and does not provide refunds for late pickups or deliveries.
7. Customer Responsibilities
- Ensure someone 18 or older is available at both pickup and delivery to sign the BOL.
- Provide accurate vehicle information and pickup/delivery addresses.
- Prepare your vehicle per our preparation guidelines (reduce fuel, remove loose items, disable alarms).
- Inspect your vehicle at delivery and note any new damage on the BOL before signing.
8. Limitation of Liability
To the maximum extent permitted by law, SWA's total liability for any claim arising from or related to our services shall not exceed the total amount paid by you for the specific shipment in question. SWA is not liable for indirect, incidental, special, or consequential damages.
9. Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in a class action lawsuit.
10. Changes to Terms
We reserve the right to update these Terms at any time. Changes become effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the updated Terms.
